摘　　要：非机动车搭载儿童是具有中国特色的道路交通现象,关注非机动车搭载儿童相关法律是建设有中国特色社会主义儿童道路交通安全法制的题中之义。在对非机动车搭载儿童的驾驶条件、儿童概念、乘车条件等进行分析的基础上,笔者提出非机动车搭载儿童的立法表述:非机动车不得载人,但由成年人驾驶、安装有符合国家标准的自行车用儿童座椅的自行车、电动自行车,可以附载一名体重为8kg—22kg(参考年龄1—6周岁)的儿童(具体数值可参考未来自行车用儿童座椅国家标准确定),且不得附载其他人员;鼓励驾乘人员佩戴(或应当佩戴)符合国家标准的安全头盔。Non-motor vehicle carrying children is a road traffic phenomenon with Chinese characteristics,paying attention to laws related to non-motor vehicle carrying children is vital to the construction of socialist children's road traffic safety legal system with Chinese characteristics.This study analyzes the driving conditions and the concept of non-motor vehicle carrying children,and puts forward the legislative statement of non-motor vehicle carrying children:Anon-motor vehicle shall not carry a person,but when a bicycle or an electric bicycle is driven by an adult,and it is equipped with a child seat meeting the national standards,it may carry a child weighing 8kg-22kg(reference age 1-6 years old)and shall not carry other persons.Meanwhile,the drivers and passengers are encouraged to wear(or should wear)safety helmets that meet national standards.
