摘　　要：根据我国宪法、立法法、地方组织法的相关规定,省级人大常委会享有对设区的市制定的地方性法规的批准权。伴随着设区的市制定地方性法规数量的大幅上升,省级人大常委会的批准权在地方立法实践中也暴露出诸如批准权的定性不明、不同批准方式使用频率差别较大、对批准权的行使缺乏监督、对批准后实施的地方性法规监督不到位等问题。要破解以上实践难题,我们需要从省级人大常委会批准权法律属性的准确厘定、省级人大常委会的提前介入机制、地方性法规的事后备案审查机制、批准权行使的监督机制等方面进行法治建构,以期实现省级人大常委会的地方性法规批准权之规范运行。According to the relevant provisions of China's Constitution,Legislation Law,and Local Organization Law,the standing committees of provincial people's congresses have the authority to approve the local laws and regulations formulated by the cities consisting of different administrative districts.With the sharp increase in the number of local laws and regulations formulated by such cities,the exercise of approval power by the standing committees of provincial people's congresses has also brought about such problems in local legislative practices as the ambiguity in the specification of approval power;the large difference in the frequency of using different approval methods;the lack of supervision over the implementation of the law;and the inadequate supervision over the implementation of the local laws and regulations after their approval.To solve the above practical problems,it is necessary to carry out the rule of law in terms of the accurate determination of the legal attributes of the approval power possessed by the standing committees of provincial people's congresses;their early intervention mechanism;the post-filing review mechanism of local regulations;and the supervision mechanism for the exercise of approval power.All this is expected to achieve the standardized operation of the approval power of the standing committees of the provincial people's congresses.
