销售侵权复制品罪“其他严重情节”的认定标准——以《刑法修正案(十一)》第21条为切入点

摘　　要：《刑法修正案(十一)》对销售侵权复制品罪的定罪标准作了重要修改,增加了“其他严重情节”的规定,并将“其他严重情节”与“违法所得数额”并列作为本罪的入罪标准之一。因此,“其他严重情节”对于销售侵权复制品罪的意义不言而喻。然而,对于何谓本罪的“其他严重情节”,目前尚无任何具体规定,亟待从理论和实践层面加以深入研究。在考量“其他严重情节”之“情节”的性质、销售侵权复制品的法益和销售侵权复制品行为入罪的司法实践经验的基础上,可以考虑将能够表明法益侵害程度的非法经营数额、复制品数量和电子网络数据等某一方面的客观事实作为“其他严重情节”的认定标准,在不完全符合上述单一情节认定标准的情况下,可考虑采用复合情节认定标准。The“Criminal Law Amendment(11)”has made important amendments to the conviction standards for the crime of selling infringing copies,adding the provisions of“other serious circumstances”,and including“other serious circumstances”and“amount of illegal income”as this crime.One of the standards of conviction.Therefore,the significance of“other serious circumstances”for the crime of selling infringing copies is self-evident.However,as to what is meant by the“other serious circumstances”of this crime,there are currently no specific regulations,and it is urgent to conduct in-depth research from the theoretical and practical levels.On the basis of considering the nature of the“circumstances”of“other serious circumstances”,the legal benefits of selling infringing copies,and the judicial practice experience of the criminalization of the selling of infringing copies,it is possible to consider the amount of illegal operations and copying that can indicate the degree of legal benefit infringement The objective facts in a certain aspect,such as the quantity of products and electronic network data,are used as the criteria for determining“other serious circumstances”.If the criteria for determining a single plot are not fully met,the criteria for determining multiple scenarios may be considered.
