民航监察员法治能力的概念与内涵研究

摘　　要：法治能力是各级领导干部和行政执法人员运用法治思维和法治方式做好治国理政、开展各项工作的能力。民航监察员的法治思维是民航监察员在履行职责过程中,以法治理念和法治精神为导向,以追求公平正义为目标,运用法律对所要处理的问题进行的逻辑推理和思维活动;法治方式则是指依据法治思维,运用法律逻辑和法律价值观处理问题、解决矛盾的方法、手段和措施。理解法治思维的内涵并养成和自觉运用法治思维是提升民航监察员法治能力的关键。法治方式则需要民航监察员学习法律方法论,掌握法律的基本原理并以大量案例分析及实务工作进行实践,方能提升法治能力。The ability under the rule of law is the ability of leading cadres and administrative law enforcement personnel at all levels to do a good job in governing the country and carrying out various work by using the thinking and mode of rule of law.The thinking of rule of law of civil aviation inspectors is the logical reasoning and thinking activities of civil aviation inspectors when using the law to handle problems in the process of performing their duties,guided by the concept and spirit of the rule of law,and aiming at the pursuit of fairness and justice;the way of rule of law refers to the methods,means and measures to deal with problems and solve contradictions by using legal logic and legal values according to the thinking of rule of law.Understanding the connotation of the thinking of rule of law and cultivating and consciously using the thinking of rule of law is the key to improve the ability of civil aviation inspectors under the rule of law.The way of rule of law requires civil aviation inspectors to learn legal methodology,master the basic principles of law and practice based on analysis of a large number of cases and practical work,so as to improve the ability under the rule of law.
