渔业管理关键环节的渔业行政处罚一般程序分析

摘　　要：作为渔业管理关键一环的渔业行政执法中的处罚程序关乎渔业法及其相关法律的具体实施效果、权威性和影响力,甚至关乎未来国家整个渔业的发展。目前渔业法之一般程序已有相应的法律法规和实施体系,但目前渔业行政执法的一般程序在具体工作实施中仍存在一些问题。因此,需要解决渔业法一般程序现存的渔业行政立法问题、有关政府部门对法律适用的问题和执法工作人员执法力度的把握问题,以及在具体实施过程中的证据采集、运用程序是否正当等问题。国家改善渔业行政执法一般程序应该加快渔业法背景下的渔业行政立法,制定统一的国家渔业行政执法程序法典;进一步整合、优化执法部门各种资源,加快渔业法约束下的渔业执法体制改革;不断加强执法人才的专业化培养,提高执法部门整体素质和能力;逐步增加渔政执法经费和设施装备,提高渔业执法人员的工作待遇;加快规范渔业执法各个环节程序,加大渔业行政处罚的监管力度;加大渔业执法内容的宣传力度,充分发挥公众舆论监督作用。As a key link of fishery management,the punishment procedure of fishery administrative law enforcement is related to the specific implementation effect,authority and influence of fishery law and related laws,and even related to the development of the whole national fishery in the future.At present,the general procedure of fishery law has corresponding laws and regulations and implementation system,but there are still some problems in the implementation of the general procedure of fishery administrative law enforcement.Therefore,it is necessary to solve the existing problems of fishery administrative legislation in the general procedure of fishery law,the application of law by relevant government departments,the grasp of law enforcement by law enforcement personnel,and the legitimacy of evidence collection and application procedures in the specific implementation process.Therefore,in order to improve the general procedure of fishery administrative law enforcement,the state should speed up the fishery administrative legislation under the background of fishery law and formulate a unified procedure code of national fishery administrative law enforcement;We should further integrate and optimize various resources of law enforcement departments,and speed up the reform of fishery law enforcement system under the constraints of fishery law;Continuously strengthen the professional training of law enforcement personnel,improve the overall quality and ability of law enforcement departments;Gradually increase the funds,facilities and equipment for fishery law enforcement,and improve the working treatment of fishery law enforcement personnel;We should speed up the standardization of all aspects of fishery law enforcement procedures,and strengthen the supervision of fishery administrative punishment;We should strengthen the publicity of fishery law enforcement and give full play to the role of public opinion supervision.
