新发展理念视域下的生态补偿制度研究

摘　　要：我国初步建立生态补偿制度已经30多年了,至今这一制度尚无实质性的进展。新发展理念视域下生态补偿制度存在的问题主要是:缺乏创新意识,制度裹足不前;无视协调发展,带来分割局面;回避共享理念,淡化补偿责任。建立和完善这一制度的困难在于生态补偿制度自身具有复杂性,我国经济社会的发展转型又加剧了完善生态补偿制度的困难,破解难题的出路是贯彻新发展理念。新发展理念视域下建立和完善我国生态补偿制度的思路,可以分为三个层面:一是以《生态补偿法》和配套法规、规章为框架,构建生态补偿制度体系;二是以中央和地方相关政策为辅助规则,进一步细化生态补偿制度;三是以群众自治中形成的民间规则为补充,充实生态补偿制度的内容。It has been more than 30 years since China initially established the system of ecological compensation,but so far,there has been no substantial progress in this system.From the perspective of the new development concept,we can see that the main problems of the ecological compensation system are:lack of innovative consciousness,system lagging behind;ignoring the coordinated development,bringing about a split situation;avoiding the concept of sharing and diluting the compensation responsibility.The difficulty of establishing and perfecting this system lies in the complexity of the ecological compensation system itself.The transformation of China's economic and social development aggravates the difficulty of perfecting the ecological compensation system.The way out to solve the problem is to implement the new development concept.From the perspective of the new development concept,the idea of establishing and perfecting China's ecological compensation system can be divided into three levels:the first is to construct the system of ecological compensation within the framework of Ecological Compensation Law and the supporting laws and regulations;the second is to further refine the system of ecological compensation with the relevant policies of the central and local governments as auxiliary rules;the third is to enrich the content of the system of ecological compensation by supplementing the folk rules formed in the mass autonomy.
