情景犯罪预防视角下非设关地走私冻品综合治理探究——以G市为例

摘　　要：新冠肺炎疫情爆发以来,受多种因素影响,G市绕关走私问题呈现增长态势,尤其是冻品走私多发频发。本文基于对G市走私冻品犯罪现状及特点的分析,得出此类犯罪具有对犯罪环境要求较高,以谋求经济利益为目的等特征。目前以打击为主的事后预防手段虽然能在一定程度上减少此类犯罪高发态势,但是在疫情防控常态化形势下,偏事后性的打击会对疫情防控带来挑战,此外有限的刑罚惩罚也使得以往以打击为主的手段收效甚微因此亟需通过事前预防为主的犯罪治理手段,有效压减此类犯罪的发生率。情景犯罪预防通过环境设计和管理抑制潜在犯罪人的犯罪决断可以在事前有效预防此类犯罪,有效提升综合治理成效,降低犯罪发生率,服务疫情防控大局。Since the outbreak of the new crown pneumonia epidemic,affected by many factors,the problem of smuggling around the border in G city has shown an increasing trend,especially the smuggling of frozen products.Based on the analysis of the current situation and characteristics of the crime of smuggling frozen goods in G city,this article concludes that this type of crime has the characteristics of higher requirements for the criminal environment and the purpose of seeking economic benefits.Although the current post-prevention methods focusing on combating can curb the high incidence of such crimes to a certain extent,under the situation of normalization of epidemic prevention and control,post-incident blows will pose challenges to epidemic prevention and control,in addition to limited penalties punishment has also made the previous methods that used strikes as the mainstay of little effect.Therefore,there is an urgent need to effectively reduce the incidence of such crimes through crime management methods that focus on prevention beforehand.Situational crime prevention through environmental design and management to suppress the criminal decision of potential criminals can effectively prevent such crimes in advance,effectively improve the effectiveness of comprehensive management,reduce the incidence of crime,and serve the overall situation of epidemic prevention and control.
