交易型腐败的典型形式与基本要素探析

摘　　要：交易型腐败的“以权谋私”,不仅包括受贿、斡旋受贿、利用影响力受贿等形式的权钱交易,还包括非法谋取个人政治利益、其他利益的权权交易、权情交易、权名交易、权色交易等典型形式。深入理解交易型腐败,需要从心理层面的交易动因、行为层面的交易方式、结果层面的交易危害等三个要素进行系统分析,从而为全面从严治党向纵深发展,全方位、全过程、全要素惩治和预防交易型腐败提供理论参考。建议在新时代反腐倡廉建设中,进一步加强“公私分明”观念的思想建设、“交易型腐败”惩治的法纪建设以及“公私冲突”预防的制度建设,一体推进不敢腐、不能腐、不想腐,最大程度化解腐败风险。Abusing power for personal gain in transactional corruption not only include power-money transaction like accepting bribes,mediatorybribe,and taking advantage of one’s influence to accept bribes,but also include many typical types of transactions,including illegally seeking for personal political rights and interests,power-power transaction concerning other interests,power-affection transaction,power-reputation transaction and powersex transaction.To gain an in-depth understanding of transactional corruption,one should conduct systematic analysis of such three elements as transaction motivation from the psychological perspective,transaction method from the behavioral perspective and transaction hazards from the result perspective,so as to provide theoretical reference for in-depth strict governance of the party and punishment and prevention of transaction corruption covering the whole process and all the elements in an all-round way.It is suggested that in the new era of combating corruption and upholding integrity,it is necessary to further enhance the ideological construction of the concept of“be scrupulous in separating public from private interests”,the establishment of a legal system to better regulate the punishment of“transactional corruption”,and the construction of systems preventing“public-private conflicts”,with the purpose of making those in power dare not to,unable to or do not want to get involved in corruption and thereby minimize corruption risks.
