黑恶势力“保护伞” 的出场逻辑、运作形式与治理对策

摘　　要：黑恶势力“保护伞”作为一种政治侵权行为,其存在和蔓延必然带来一种社会抗争,直接影响中国共产党的执政根基和执政形象。从演绎形式看,“保护伞”的形成主要包括权钱渗透型、包庇纵容型和组织领导型,是公共权力与个体私利融合的结果。要破除“打伞”行为,需要构建完善的问责、司法干预制度,确立人民民主、民本价值理念,实施常态化的群防群控战略。As a form of political tort,the existence and spread of the “protection umbrella”of gang crimes will inevitably bring about a kind of so-cial struggle,which directly affects the ruling foundation and the image of the Communist Party of China.From the perspective of deductive form,the for-mation of“protection umbrella”mainly includes these three types of power and money penetration,shielding and conniving,and organizational leader-ship,which stems from the integration of public power and individual self-in-terest.To get rid of the“protection umbrella”behavior,a sound system of accountability and judicial intervention need to be set up,together with the nourishment the people's democratic and people-oriented values,so as to implement the normalized group prevention and control strategy.
