铁路运输行业恐怖活动处置职责的划分

摘　　要：厘清铁路运输企业与铁路公安机关各自的反恐职责,可以使两者在防范恐怖活动时,既发挥各自优势,又形成合力,从而取得良好的工作效果。通过对现有法律法规进行梳理,结合各自的工作特点,分析发现两者在处置恐怖活动时应有不同的侧重点:铁路运输企业应侧重于保障安全生产,铁路公安机关应侧重于制止违法行为。在此基础上结合各自的反恐优势,对两者处置恐怖活动的职责进一步细化,可为立法和实践提供积极参考。It will improve the work effectiveness to clarify the responsiblity between railway enterprises and railway public security organs when fighting terrorism,for enforcing their respective advantage and forming a joint force against such crimes.Based on the enacted laws and regulations,and considering the work features of both sides,each shoud put different emphasis on handling the terrorist crimes.Railway enterprises focus on ensuring safe production,while railway public security organs focus on deterring illegal acts.Thus they will combine best edges against terrorism.Moreover,their responsibilites can be further refined in handling such cases to provide reference to legislation and law enforcement.
