电信网络诈骗犯罪侦查思路探析

摘　　要：随着互联网经济和电信产业迅猛发展,电信网络在推动经济社会发展的同时,也成为不法分子实施犯罪的重要平台,由此催生了犯罪结构和类型的深刻变化。特别是在疫情防控常态化背景下,电信网络诈骗已成为当前发展最快、严重影响人民群众安全感的刑事犯罪,呈现出诈骗犯罪手段不断变化、智能化程度不断提高等特点。从侦查打击的实战视角,探讨当前电信网络诈骗的总体态势,阐明电信网络诈骗犯罪的背景及相关立法,列举接处警工作中需要记录的关键细节,提出侦查打击电信网络诈骗犯罪的基本路径,以更有效地预防打击该类犯罪。With the rapid development of Internet economy and telecommunication industry,telecommunication and network promote the economic and social development.At the same time,it provides a major platform to commit crimes,and brings profound changes to crime structure and types.Especially during the normalization of Covid-19 epidemic prevention and control,telecom and network fraud has become the fastest-growing crime and seriously threaten people’s sense of security.It presents features such as the constant change of frandulence,increasing degree of intelligence.Based on the actual meausres of investigation and crackdown,the overall situation of current telecom and network fraud is discussed.It presents the background and relevant legislation about telecom and network fraudulence,gives key details that need to be recorded while receiving and handling the reports,and suggests the basic path for investigation of the telecom and network fraudulence,so as to prevent and crack down such crimes more effectively.
