摘　　要：最高人民法院在OPPO公司诉夏普公司标准必要专利许可纠纷案的二审管辖权异议裁定中认定,我国法院对标准必要专利全球许可条件纠纷拥有管辖权,这是最高人民法院首次在诉讼程序上明确我国法院拥有裁判标准必要专利全球许可条件案件的管辖权,但是标准必要专利全球许可条件司法裁判的具体规则仍待研究。在审理该类案件时,法院应尽力促成双方达成FRAND许可协议,在双方充分协商但仍无法达成许可协议的情况下,可以裁判标准必要专利全球许可条件。裁判标准必要专利全球许可条件应遵循FRAND原则和尊重商业惯例,可以根据权利人拥有的标准必要专利分布的地域范围和实施人生产、销售无线通信产品的市场情况,裁判一个全球统一的许可费率,或者区分不同国家的市场区域裁判若干个许可费率。如某一域外法院已就本国的许可费率作出裁判,我国法院裁判全球许可费率时可以根据具体情况决定是否据此调整费率。法院作出标准必要专利全球许可条件判决后,应保障判决得到切实履行,可通过适用行为保全或民事一审判决先予执行制度,促成双方尽快达成FRAND许可协议。In the second instance of OPPO vs.Sharp,the Supreme People's Court held that,according to the principle of closer contact,Chinese courts have jurisdiction over the global licensing conditions of standard essential patents(SEP),which is a milestone in the judicial practice of SEP in China.There is no precedent for Chinese courts to judge the global licensing conditions of SEP in substance.This paper tries to study the new complicated problems in the trial of global license conditions for SEP.When hearing such cases,Chinese courts should exert judicial initiative and try their best to facilitate both parties to reach FRAND license agreement.In the case that both parties cannot reach license agreement after full consultation,the court can decide the global license conditions of SEP.Decision criteria necessary global patent licensing conditions shall comply with the principles of FRAND requirement and respected business practices,can according to the standard necessary patent holder with the regional scope of SEP patent and implementation of production and sales of wireless communication products market situation and the two sides,ruling a global unified licensing fees,or differentiate the market area of different countries ruled several licensing fees.If an extraterritorial court has made a ruling on the domestic licensing rate,our court shall decide whether to adjust the rate accordingly in determining the global licensing rate on a case-by-case basis.In accordance with the provisions of the law,it is necessary to guarantee the implementation of the global licensing conditions of SEP adjudicated by Chinese courts.Through the applicable act preservation or civil first-instance judgment advance execution system,the court can promote both sides to reach a FRAND agreement as soon as possible.
