摘  要:早在晋朝时期,刘颂从维护审判公平、公正与合法的角度出发,提出了断罪引律令的主张。此后,“断罪引律令”成为中国古代刑法中罪刑法定的渊源。中国古代的罪刑法定与西方社会提出的罪刑法定原则有本质不同。这主要是因为中国古代的审判依据不仅包括成文法律,还包括天理和人情。司法官员在审理案件时需要综合考虑这三方因素来实现维护平衡社会关系的目的。The principle of legally prescribed punishment for a crime originated in the struggle of western bourgeoisie against feudal autocratic rule.In China,as early as in the Jin Dynasty,Liu Song put forward the proposition of justifying crime and citing law from the perspective of maintaining justice,justice and legality.Since then,“justifying the crime and citing the law”has become the source of legal punishment for a crime in ancient Chinese criminal law.But even so,the principle of legalization of punishment for a crime in ancient China can only be called legalization of punishment for a crime,which is essentially different from the principle of legalization of punishment for a crime proposed in the West.This is mainly because ancient Chinese judicial basis includes not only written laws,but also nature and human feelings.Judicial officials need to take these three factors into consideration when trying cases to achieve the goal of maintaining equitable social relations.
