摘　　要：法文化中的婚恋自由表征着中国传统自由的内在张力,由此入手,对中国传统自由的脉络进行梳理,可最大限度地呈现自由的本土精华。《民法典》婚姻家庭编既是自由张力的法律表达,又为自由设定了边界。将自由的内在张力和边界统一起来,为人的自由全面发展提供保障,是学界和实务界的共同任务。The freedom of marriage in legal culture characterizes the intrinsic tension of China's traditional freedom.From this,we can sort out the vein of China's traditional freedom and maximize the freedom of the local essence.The marriage and family part of the civil code is not only the legal expression of freedom,but also sets the boundary for freedom.It is the common task of academic and practical circles to unify the internal tension and boundary of freedom and provide guarantee for people's free and all-round development.
