从“人民”到“人民至上”——兼论欧陆行政学以来“人民”价值的嬗变与发展

摘　　要：人民是唯一的吗?人民是人还是民?人民是谁?对人民的审视,关联着现代国家的行政合法性与正当性,也构成了公共性的价值根基。基于学术史的梳理,重新将“人民”引入行政学的发展脉络,可以看到在理论和实践取向上,“人民”总是在形式和口号上成为行政目标的代名词,其价值蕴涵经历了数次内部的分化与流变,最终实现了行政公共性等同于人民权力与价值的理论确认。“人民至上”作为一种行政价值,在实践和价值的双重维度上引领了我国公共生活与行政变革的良序发展,让马克思主义崇高的社会理想在伟大的社会主义制度实践中显示出正当性与确证科学性。Are the people unique?Do the people belong to"people"or"the people"?Who are the people?The examination of the people is related to the administrative legitimacy and legitimacy of the-modern state,and also constitutes the value foundation of publicity.Based on the analysis of academic history,envolving"people"into the development of administration,we can find that in theory and practice orientation,"the people"has always become the slogan and pronoun of administrative target,whose value has experienced several internal changes and developments,and finally achieved the theoretical confirmation that the administrative publicity is equivalent to the people."People first"leads the orderly development of China's public life and administrative reform in the dual dimensions of practice and value,heralding the appearance of a new public development value,and finally anchoring the scientific value of"people".
