我国医疗纠纷第三方调解机制的困境与出路

摘　　要：近年来我国医疗纠纷日益增多,诉讼压力增大,医疗纠纷第三方调解经历了从“北京模式”“上海模式”“宁波模式”的实践探索以及顶层设计后的迅速发展,在加强调解机构中立性、提升调解人员专业性、拓宽财政经费来源等方面取得了一定的成果,但仍面临着认同度和公信力不高等现实困境。医疗纠纷第三方调解公信力困境的内在原因主要在于调解主体的中立性偏离、调解程序的专业性和规范性不足以及诉调衔接机制的不完善。我国医疗纠纷第三方调解机制的完善路径主要包括:加强对第三方调解的宣传力度、提升调解的专业性与规范性、强化第三方调解组织的中立性以及从主体、程序、效力等方面完善诉调衔接机制。In recent years,with China's medical disputes increasing and the litigation pressure increasing,the third-party mediation of medical disputes has experienced the practical exploration from the“Beijing model”,“Shanghai model”and“Ningbo model”and the rapid development after the top-level design.It has made some achievements in strengthening the neutrality of mediation institutions,improving the professionalism of mediators and broadening the source of financial funds,but it still faces the realistic dilemma of low recognition and credibility.The internal causes for the credibility dilemma of the third-party mediation of medical disputes mainly lie in the deviation of the neutrality of the mediation subject,the lack of professionalism and standardization of the mediation procedure,and the imperfection of the connection mechanism of litigation and mediation.The ways to improve the third-party mediation mechanism of medical disputes in China mainly include:strengthening the publicity of third-party mediation,improving the professionalism and standardization of mediation,strengthening the neutrality of third-party mediation organizations,and improving the connection mechanism of litigation and mediation from the aspects of subject,procedure and effectiveness.
