我国耕地土壤污染防治立法探析

摘　　要：耕地土壤污染是当前最严重的环境问题之一,严重制约了耕地资源的可持续利用和农业的可持续发展。法律是解决耕地土壤污染问题最有效的措施之一,但我国现行的耕地土壤污染防治立法存在不足,严重制约了其功能的有效发挥。完善耕地土壤污染防治立法,应当从我国的实际出发,在借鉴国际社会有益经验的基础上,有针对性地采取相关措施。建议制定单行的《耕地土壤污染防治办法》,修改现行法律的相关内容;强化环境管理机构的强制性手段,协调利益关系;健全相关的配套性措施和救济机制;改革执法体制;严格法律责任,为耕地土壤污染防治事业健康发展提供有力保障。Cultivated land soil pollution is one of the most serious environmental problems,which seriously restricts the sustainable utilization of cultivated land resources and the sustainable development of agriculture.Law is one of the most effective measures to solve the problem of cultivated land soil pollution,but there are deficiencies in China’s current legislation on the prevention and control of cultivated land soil pollution,which seriously restricts the effective play of its function.In order to improve the legislation on the prevention and control of cultivated land soil pollution,we should start from the reality of our country and take targeted measures on the basis of learning from the useful experience of the international community.It is suggested to formulate a law for the prevention and control of cultivated land soil pollution,modify the relevant contents of the current law;strengthen the mandatory means of environmental management institutions and coordinate interest relations;improve relevant supporting measures and relief mechanisms;reform law enforcement system;and clarify strict legal liability to provide powerful guarantee for the prevention and control of cultivated land soil pollution.
