摘 要:我国目前采取了内部监督与外部监督相结合的公平竞争审查监督方式,但内部监督及外部监督的相关依据散见于公平竞争审查制度的配套文件之中,并且当前公平竞争审查监督机制的相关规定均较为原则化,缺乏对于公平竞争审查体系化监督的细化规定,难以为监督工作提供实际、可靠、合理的路径依据。为此,有必要深入分析我国公平竞争审查现行监督机制存在的不足,并在此基础上有针对性地对监督机制进行优化。内部监督方面,我国可参照OECD的先进经验确定科学可行的定期评估周期,将适用例外规定政策措施的逐年评估交由政策制定主体负责。外部监督方面,我国应建立畅通高效的社会公众举报渠道,着力提升公平竞争审查案例信息公开的充分性、规范性和及时性。China currently adopts competition review supervision method that combines internal supervision and external supervision,but the relevant basis of internal supervision and external supervision is scattered in the supporting documents of the fair competition review system,and the current fair competition review supervision mechanism is related to the regulations which are relatively principled,lacking detailed regulations for the systematic supervision of fair competition review,and it is difficult to provide a practical,reliable and reasonable path basis for the supervision work.To this end,it is necessary to deeply analyze the shortcomings of the current supervision mechanism of China's fair competition review,and on this basis,to optimize the supervision mechanism in a targeted manner.In terms of internal supervision,China can refer to the advanced experience of the OECD to determine a scientific and feasible periodic evaluation cycle,and entrust the annual evaluation of the policy measures with exceptions to the responsibility of the policy-making body.In terms of external supervision,China should establish smooth and efficient public reporting channels,and strive to improve the adequacy,standardization and timeliness of information disclosure of fair competition review cases.
