对新《档案法》规制档案销毁的解读与思考

摘　　要：通过对比分析2020版新《档案法》与1987版、1996版《档案法》关于对档案销毁的规制,发现档案销毁工作"销有据"特征的不变性。从销毁档案,首先要鉴定需销毁的档案;销毁档案,需遵循保密与保护党和国家利益的依据;销毁档案,需依据严格的程序和办法三个方面对法律规制下的档案"销有据"特征的具体内涵进行解读。档案法律法规中对档案销毁进行限制,也就是档案"销有据"特征,并不是我国独有的,国外也有类似的规定。这说明档案"销有据"特征在国外档案管理工作中也是广泛存在的,由此可见这一特征的普适性与生命力,这应该是档案与档案工作本身共有的内在规律与特征。By comparing and analyzing the regulations on archive destruction of the new "Archives Law" of the 2020 edition and the "Archives Law" of the 1987 and 1996 editions,we have discovered the invariability of the characteristics of "sales evidence" in the work of archives destruction. From destroying archives, we must first identify the archives that need to be destroyed;destroying archives must follow the basis of confidentiality and protecting the interests of the party and the country;destroying archives must follow strict procedures and methods to "sell the archives under legal regulations." Interpretation of the specific connotation of the feature. The restrictions on the destruction of archives in the archives laws and regulations, that is, the "sales evidence" feature of archives, are not unique to our country, and similar regulations are also available abroad. It shows that the characteristic of “sales evidence” of archives is also widely present in foreign archives management. This shows the universality and vitality of this characteristic, which should be the internal law and characteristic shared by archives and archives itself.
