摘  要:在可持续发展上升为国家战略层面背景之下,租赁改造废旧厂房用之于公共体育服务,使存量工业用地得到可持续提升利用,以实现对国内紧张的体育场地资源的有益补充。但是随着该类项目的发展,厂房征收等现实问题日益暴露出来。运用文献资料法、案例分析法、逻辑推理法,对旧厂房改造型体育设施项目厂房征收过程中承租人的利益损失范围进行全面梳理,说明该类体育设施在厂房被征收时保护商业承租人利益的必要性,并构建旧厂房改造型体育设施项目承租人权益保护之理论进路与解释框架。As sustainable development has become a national strategy,it is significant that sports facility project from old workshop renovating makes full use of stock industrial land and becomes the necessary complement to the shortage of stadium resources.With the development of these projects,the problems of factory building expropriation are increasingly exposed.Using the method of documentary and case analysis and logical reasoning,this paper summarizes a series of risks on expropriation of factory building versus this mode.It is concluded that the lessee’s rights in sports facility project from old factory building renovating should be protected.In a shortage of the related laws,this article presents the path framework of guaranty of lessee’s rights in these types of projects.
