个人信用报告不良信用信息多元修复路径衔接研究

摘　　要：我国制定法层面个人信用报告中不良信用信息的修复路径主要有自然修复、更正修复及注释性修复等三种方式,现行理论界呼吁立法引入申请修复的信用修复方式,但并未对申请修复路径引入后,如何与既有的修复方式相衔接作出回应。无论是制定法层面还是理论层面,信用修复各路径的共同效用旨在恢复信息主体的信誉利益和民事行为能力,而检视每一种修复路径,各有其目的效用、积极效用及消极效用。沿着效用分析的进路,厘清各修复路径之间的冲突和联系,在各信用修复路径共同效用的指引下,以不良信用信息产生的原因作为切入点,对自然修复进行价值、立法重构,使申请修复与更正修复在适用程序上相一致,将注释性修复方式修复后不良信用信息纳入申请修复范围,从而促使各修复路径间得以相互衔接。There are three ways to repair bad credit information in personal credit reports at the legislative level in China, including natural repair, correctional repair and explanatory repair. The current theoretical circle calls for legislation to introduce the credit repair method for application for repair, but does not respond to how to connect with the existing repair methods after the introduction of the application for repair. Whether at the legislative level or at the theoretical level, the common utility of each path of credit restoration aims to restore the credit interests and civil behavior ability of information subjects, while examining each path of restoration has its purpose utility, positive utility and negative utility. By extending the approach of utility analysis and clarifying the conflicts and connections among various repair paths, under the guidance of the common utility of each credit repair path, the value and legislative reconstruction of natural repair are carried out with the causes of bad credit information as the starting point, so that the application repair is consistent with the correction repair in the application procedure, and the bad credit information after the repair of the explanatory repair method is included in the scope of the application repair, so as to promote the connection between various repair paths.
