摘  要:技术人员要想真正成为专利的发明人,则必须从纯粹的技术思维模式转向"技术思维+专利思维"模式,将专利思维贯穿于技术活动的全过程,克服既有的思维范式和刚性,对解决技术问题过程中具有新颖性和创造性的专利素材进行系统的挖掘、梳理和归纳,对技术方案和技术特征进行深度剖析和判定,调整文献检索的目的,完成高质量技术交底书,提出合理的权利要求,有助于代理师对说明书及权利要求的撰写、修改和完善,准确答复审查意见和复审意见,使得授权专利具有更高质量。For a technician to become a real inventor,one must think like an inventor.That is,we think beyond the technical matters throughout our technical activities-we keep the idea of "patent" in mind.We must overcome our existing thinking paradigm as technicians and start recognizing,exploring,understanding,and organizing the novel,creative,patentable materials we encounter in the process of solving technical issues.Further,we must thoroughly analyze and identify technical features and technical solutions,adjust the purposes of bibliographic retrieval,prepare sterling patent descriptions,and raise reasonable patent claims.By doing so,we help a patent agent produce and perfect a patent specification and claim,accurately respond to an examination opinion and a review opinion,thereby ensuring a higher-quality patent.
