摘　　要：作为纯粹法学理论问题,新型财产的法律属性争论繁多,未有定论。而新型财产的保护诉求则驱使司法机关从实用主义出发,不以其法律属性为前提,而是径直认定新型财产的效用和价值。这种新型财产利益的确认方式实质上是利益论的权利生成模式,即符合三重利益要素的新型财产利益即可上升为一项权利,从而准用一般财产权的保护规则。同样,网络虚拟财产的权利化路径也遵循此种论证模式。在网络虚拟财产权的保护上,有两种路径可供选择:其一,将网络虚拟财产纳入到新型民事权利客体中,并明确为一项独立于物权和债权的、可支配的新型财产权。其二,将安全保障义务的适用范围扩张至网络环境,若游戏运营商与用户对安全保障义务有明确约定,此时侵权责任与违约责任发生竞合,由用户择一行使;若双方未约定安全保障义务,则基于网络虚拟财产权的独立性,将安全保障义务视为法定义务。As a purely theoretical issue of law,there are many disputes about the legal attributes of the new type of property,and there is no conclusion.The demand for the protection of new types of property drives the judiciary to proceed from pragmatism,not based on its legal attributes,but to directly determine the utility and value of new types of property.This new type of property interest confirmation method is essentially the right generation model of the theory of interest,that is,a new type of property interest that conforms to the triple interest elements can be elevated to a right,so that the general property rights protection rules apply.Similarly,the right path of network virtual property also follows this argumentation model.In the protection of network virtual property rights,there are two paths to choose from:First,the network virtual property is included in the new type of civil rights object,and it is clearly defined as a new type of disposable property right that is independent of property rights and creditor’s rights.Second,expand the scope of the security guarantee obligation to the network environment.If the game operator and the user have a clear agreement on the security guarantee obligation,at this time the tort liability and the breach of contract liability coincide,and the user chooses one to exercise;if the two parties have not agreed security obligations are based on the independence of network virtual property rights,and security obligations are regarded as legal obligations.
