海南自贸港知识产权司法保护制度创新研究

摘　　要：海南自由贸易港知识产权司法保护存在保护制度缺少体系化建设、保护水平难以对标国际标准、知识产权法院仍处于探索阶段发挥作用有限等问题。中国香港、上海自贸港(区),国外新加坡、美国和欧盟等自贸港(区)都实行知识产权行政保护和司法保护双轨模式,在知识产权司法保护上有较多成熟经验可供借鉴。海南自由贸易港知识产权司法保护制度的完善应当加快自贸港知识产权司法保护制度体系化建设、切实提高海南自贸港知识产权司法保护水平和逐步推进自贸港知识产权法院机制化运作,以实现海南自贸港高水平与高标准的知识产权司法保护目标。There are some problems in the judicial protection of intellectual property rights in Hainan Free Trade Port(FTP).For instance,the protection system lacks systematic construction,the level of protection failed to meet international standards,and the intellectual property court is still in the exploratory stage and its role is limited.FTPs in Singapore,the United States,the European Union,Hong Kong and Shanghai have all implemented the dual-track model of administrative and judicial protection of intellectual property rights,which can provide experience for Hainan FTP.Hainan FTP should accelerate the systematic development of a judicial protection system,improve the level of judicial protection of intellectual property and gradually advance the institutionalized operation of the intellectual property courts in order to achieve the goals of high-level and high-standard intellectual property judicial protection of Hainan FTP.
