摘 要:近年来,新经济蓬勃兴起,催生了大量的灵活就业者,亟需对灵活就业进行合理规制。我国早期的灵活就业以被动型非正规就业为主要形式,以舒缓数量型就业矛盾为目的,可以采用相对松散的规制原则。而新经济下的灵活就业在就业动机、就业属性、就业质量以及劳动者权益诉求等方面均已发生转变,以主动型正规就业为主要形式,以舒缓质量型就业矛盾为目的,应采用相对规范的质量优先的规制原则。因此,必须加强对灵活就业的正规化管理,包括规范企业灵活用工,从实质从属性角度认定劳动关系,健全灵活就业者社会保障体系等。In recent years,the vigorous rise of the new economy has spawned a large number of flexible employment,and there is an urgent need for its reasonable labor regulation. The early flexible employment in China was mainly in the form of passive informal employment,which aimed at alleviating the contradiction of quantitative employment,and thus a relatively loose regulation principle could be adopted. In the new economy,flexible employment has changed in terms of employment motivation,employment attributes,workers’ rights and interests. It takes active formal employment as the main form and aims to alleviate the contradiction of quality employment,and a relative norms labor regulation should be adopted. Therefore,it is necessary to strengthen the formalized management of flexible employment,including regulating the flexible employment of enterprises,identifying labor relations,and improving the social security system for flexible employees.
