摘 要:基于受众视角探讨人工智能生成物的版权保护问题,可以避免因采取作者中心主义而产生的分歧。在《中华人民共和国著作权法》中,受众指对特定作品具有一定精神需求的群体。受众视角下,为全面维护受众在微观与宏观层面上的利益,有必要给予人工智能生成物版权保护。以“法人作品”制度作为人工智能生成物版权保护的具体路径,可以克服作者中心主义,符合受众的利益要求。为平衡受众与权利人之间的利益,应当从保护期限、版权登记和法定许可这三个方面对人工智能生成物的版权保护进行限制。Exploring copyright protection of artificial intelligence products from the perspective of audience can avoid disputes caused by the author's centralism.“Audience”refers to the group that has a certain spiritual demand for a particular work in copyright law.Under the perspective of audience,in order to fully protect the interests of the audience at the micro and macro levels,it's necessary to provide copyright protection for artificial intelligence products.It's appropriate to take the system of“corporate works”as the specific path for copyright protection of artificial intelligence products,because it can overcome the author's centralism and meet the interests of the audience.In order to balance the interests between the audience and the obligee,the copyright protection of artificial intelligence products should be limited from the aspects of duration of protection,copyright registration and statutory license.
