摘　　要：版权“钓鱼维权”行为不仅影响了作品创作、浪费了司法资源,也破坏了版权生态,其主要原因在于互联网背景下版权制度滞后于技术变革、网络用户版权意识不强以及行为人对高额“维权”利益的追逐。完善网络版权登记制度,引入默示许可制度和“三振出局”制度,是规范版权行使行为,提升网络用户版权意识,促进版权生态市场健康发展的有效措施。The behavior of copyright of"phishing law enforcement"not only affects the creation of works,wastes judicial resources,but also harms the copyright ecology.The main reasons are that the copyright system lags behind the technological change under the background of the Internet,the weak copyright awareness of network users,and the actor's pursuit of high"rights protection"interests.Improving the network copyright registration system and introducing the implied license system and the"strike three out"system are the effective measures to standardize the exercise of copyright,improve the copyright awareness of network users and promote the healthy development of copyright ecological market.
