噪声污染防治立法的审思与突破

摘　　要：立足现实,面向未来,《环境噪声污染防治法》的完善应以习近平生态文明思想为指引,将噪声污染防治立法纳入生态文明建设整体布局。通过“生态优先原则”的确立、“公众参与原则”的引入以及“风险预防原则”的设定,结合敏感点噪声控制制度、产品噪声名录制度、噪声污染环境公益诉讼制度等具体制度的实施,从立法理念的生态化、法律名称表达的规范化、噪声污染定义的科学化以及侵权归责原则适用的二元化出发,构建满足公众美好生活需要、涵盖物种利益保护的噪声污染法律治理网络,最终实现我国噪声污染治理体系、治理能力的现代化。Based on the reality and facing the future,the improvement of Law on Prevention and Control of Environmental Noise Pollution should be guided by Xi Jinping Thought on Ecological Civilization,and the legislation on the prevention and control of noise pollution should be incorporated into the overall layout of ecological civilization construction.Through the establishment of“ecological priority principle”,the introduction of“public participation principle”and the establishment of“risk prevention principle”,combined with the implementation of specific systems such as sensitive point noise control system,product noise list system,noise pollution environmental public interest litigation system,starting from the ecological legislative ideas,the unified names and expressions,the scientific noise pollution definition and dualization of application of tort imputation principle,a noise pollution legal governance network can be constructed to meet the needs of the public for a better life and to cover protection of species interests,finally to realize the modernization of Chinese noise pollution governance system and ability.
