摘 要:国际铁路提单目前主要在中欧班列试行,在其商业运作实践中存在缔约成本增加、提单与运单并用冲突、法律纠纷风险增大等问题,既不利于其在国际贸易中的推广适用,也无法真正有效解决陆上国际贸易的交易安全和融资担保问题。国际铁路提单亟待从国内法和国际法角度加以规范,其中,尤为关键的是从法律上强调铁路提单的提货权属性并确立其优先性、无因性,并围绕提货权这一核心权利设置特定的附属权利和附属义务,以及解决国际铁路提单提货权与相关国内法及国际法相互冲突的问题。At present,the international railway bill of lading is mainly implemented in CR Express.During its business operation practice,there are problems such as increased contracting costs,conflict between bills of lading and consignment note,and increased risk of legal disputes,which are not conducive to its promotion and application in international trade,nor can it effectively solve the problems of transaction security and financing guarantee in international land trade.The international railway bill of lading needs to be regulated from the perspective of domestic law and international law.The key point is to emphasize the right of delivery of railway bill of lading in law and establish its priority and no-cause character,set up specific subsidiary rights and obligations around the core right of delivery,and solve the conflict concerning the right of delivery of international railway bill of lading between domestic law and international law.
