信用承诺、信用报告及信用修复等在卫生健康监督执法领域的合法性研究

摘　　要：现阶段,全国社会信用体系建设正在深入开展,建立卫生健康信用监管新模式也在积极推动,提升监督执法工作方式升级和效能提升是其中一项重要的内容。本文通过理论(含合法性)研究和地区试点相结合,为建立健全信用承诺制度,积极探索拓展信用报告及信用修复应用等方面进行探讨,针对目前卫生健康相关法律法规相对滞后等问题,对信用机制的合法性研究提供法律依据和理论基础。At present,the national social credit system is being built in a deep-going way.The establishment of new health credit supervision mode is also being promoted.As one important job in this new mode,the supervision and law enforcement needs to upgrade its manner and improve its efficiency.Through the combination of theoretical research(including legitimacy)and regional experiment,this paper actively explores and develops the application of credit report and credit repair for the establishment and improvement of credit commitment system.In view of the relative hysteresis problem on current health-related laws and regulations,this paper provides legal basis and theoretical foundation for the legitimacy research of credit mechanism.
