摘 要:地理标志凝聚了独特的自然人文特征,承载着极大的经济价值,已经成为我国"十四五"规划打造特色农产品优势区,推进乡村全面振兴的重要抓手。目前在国际上对地理标志呈现出不同的保护模式。经过多年的发展,我国也逐步形成了地理标志商标、地理标志产品以及农产品地理标志三种保护模式并列的局面。但三种模式在实践中存在保护重叠、标准不一等困境,制约着我国地理标志保护的发展。在《民法典》将地理标志独立规定为知识产权客体的背景下,我国应当制定专门的《地理标志保护法》,再分设不同产品的具体保护制度,同时辅以不同行业实施标准,以实现地理标志保护的系统性、专业性规制。Geographical indications embody unique natural and cultural characteristics and carry great economic value. They have become an important starting point for China’s “Fourteenth Five-year Plan” to build advantageous areas of featured agricultural products and promote the overall revitalization of rural areas. At present, there are different protection modes for geographical indications in the world. After years of development, China has gradually formed the co-existence of three protection modes of geographical indication trademark, geographical indication products and agricultural products of geographical indication. However, there are overlapping protection and different standards in practice, which restrict the development of geographical indication protection in China. Under the background that geographical indications are independently defined as the object of intellectual property in the Civil Code, China should formulate the specialized Geographical indication Protection Law and then set up specific protection systems for different products, which are supplemented by implementation standards for different industries, so as to achieve systematic and professional regulation of geographical indication protection.
