关于完善我国自然资源法律体系的思考

摘　　要：中国自然资源法律体系主要涵盖土地、水、矿产、森林、草原、海洋、野生动植物等自然资源类型。在对自然资源法律体系内涵进行界定的基础上,对国家自然资源法律体系的发展历史进行了考察,从体系架构和制度建设2个方面,剖析了自然资源法律体系存在的体系不健全、资源所有权落实、有偿使用和使用权流转等资源管理关键制度不完善或存在缺失等问题。建议推动制定《自然资源基本法》,优化自然资源法律制度框架,突出重点制度的完善,加快推进重要资源的立法或修改,从而完善中国的自然资源法律体系。China's natural resource legal system mainly covers the types of natural resources such as land,water,minerals,forests,grasslands,oceans,wild animals and plants.On the basis of defining the connotation of the natural resource legal system,the development history of China's natural resource legal system is investigated.From the two aspects of system structure and system construction,problems such as the imperfection of the natural resource legal system and the imperfect or missing key systems of resource management such as the implementation of resource ownership,paid use and transfer of use rights are analyzed.It is suggested to promote the formulation of the Basic Law of Natural Resources,optimize the legal framework of natural resources,highlight the improvement of key systems,and accelerate the legislation or revision of important resources,so as to improve China's natural resources legal system.
