摘　　要：伴随种业市场的放开与发展,虽然为大量种子经营商家提供了更多的市场机会,但也增加了竞争市场中种子质量的风险,从而对种子使用者的合法权益受到严重影响。为此,本研究在分析了中国现阶段存在的种子使用者权益受损现象的基础上,指出导致种子使用者权益受损的主要原因包括:种子种植者法律意识淡薄、种子市场监管制度较缺乏、种子的法律法规有待完善。并基于现存问题提出相关改进及优化措施,以期对中国政府更好地完善种子法律法规、规范种子市场秩序、维护种子使用者合法权益等工作提供借鉴。With the liberalization and development of the seed industry market, it not only provides more market opportunities for a large number of seed operators, but also increases the risk of seed quality in the competitive market, which seriously affects the legitimate rights and interests of seed users. For this reason, based on the analysis of the damage to the rights and interests of seed users in my country at this stage, this article points out that the main reasons for the damage to the rights and interests of seed users include: seed growers have weak legal awareness, the seed market supervision system is relatively lacking, seed laws and regulations need to be improved. Based on the existing problems, relevant improvement and optimization measures are proposed in order to provide reference for the Chinese government to better improve seed laws and regulations, regulate the order of the seed market, and safeguard the legitimate rights and interests of seed users.
