中国农业种子市场的监管现状及法律问题研究

摘　　要：种子是农业生产中最基础的生产资料,与人类生存与发展密切相关,种子市场的发展与国家农业经济发展紧密关联。为此,本研究从农业种子市场的角度出发,在分析了中国农业种子市场监管现状的基础上,指出中国农业种子法律体系中存在种子企业市场准入制度不严格,种子品种质量审定制度不完善,种子违法行为责任制度不明确等法律问题。再基于现存问题有针对性地提出种子市场优化建议,以期对中国政府更好地部署种业市场管理工作提供参考。Seeds are the most basic means of production in agricultural production and are closely related to human survival and development. The development of the seed market is closely related to the development of the country’s agricultural economy. For this reason, this study starts from the perspective of the agricultural seed market and analyzes the current situation of agricultural seed market supervision in China. It points out that in the legal system of agricultural seed in China, the market access system for seed companies is not strict, and the quality of seed varieties is not perfect. Legal issues such as the unclear responsibility system for seed illegal acts. Based on the existing problems, we put forward specific suggestions for seed market optimization, in order to provide reference for the Chinese government to better deploy seed industry market management.
