摘 要:在信息时代快速发展背景下,转基因技术的应用不断面临着来自于公众的质疑。因此,对于转基因技术风险的研究和管理也进入了学术界视野中,学术界对于转基因技术风险研究也逐渐达到了成熟的地步。随着对转基因技术风险研究的持续深入,也收获了很多与转基因技术风险相关的研究成果。目前,关于转基因技术风险的法律法规依然存在不足之处。因此,本研究首先分析和整合中国转基因技术风险法律规制方面的现状及问题,然后借鉴一些发达国家在转基因风险法律制度方面的经验,最后结合中国转基因风险法律规制实际情况,从风险防范原则、监控评价以及公众参与等制度方面完善中国现有的转基因技术风险制度体系。In the context of the rapid development of the information age, the application of transgenic technology is constantly facing doubts from the public. Therefore, the research and management of the risks of transgenic technology has also entered the field of academia, and the research on the risks of transgenic technology has gradually reached a mature level. With the continuous in-depth research on the risks of genetically modified technology, many research results related to the risks of genetically modified technology have also been obtained.At present, the laws and regulations on the risks of GM technology still have deficiencies. Therefore, this paper firstly analyzes and integrates the current situation and problems in the legal regulation of GM technology risks in my country, then draws on the experience of some developed countries in the legal system of GM risks, and finally combines the actual situation of my country’s GM risk legal regulation, from the principles of risk prevention,monitoring and evaluation. And public participation and other systems to improve my country’s existing genetically modified technology risk system.
