论行政控权的技术路径

摘　　要：由于外部监督机制功能发挥受限,来自行政系统内部的行政控权成为实现法治政府规范公权力要求的重要方式。既有行政控权机制缺乏对具体行政过程中行政人员非法用权的关注,直接影响了行政控权的实效。通过中立性、客观性的技术路径,行政机关能够实现对行政决策、行政执法的规制功能,并催生规范决策、执法的动力。有效的技术路径减少了行政过程中的非法用权现象,弥补了既有控权机制的不足,能够迅速推进行政控权的功能实现。建立内部多级别开放系统、设置独立的专门技术部门和形成技术路径法规是顺利推行技术路径的必要保障。技术路径自身也有功能限度,既无法完全代替行政人员的作用,也存在监管盲区。行政控权功能的实现需要依靠制度建设、行政人员职业素养的提高和技术路径的协作。Due to the limited function of the external control and supervisory mechanism,the administrative control power from within the administrative system has become an important way to realize the requirements of the rule of law government to regulate the public power.The existing administrative power control mechanism lacks attention to the illegal use of power by administrative personnel in the specific administrative process,which directly affects the effectiveness of administrative power control.Through the neutrality and objectivity of the technological path,administrative agencies can realize the regulatory function of administrative decision-making and administrative law enforcement,and give rise to the power of standardized decision-making and law enforcement.An effective technological path reduces the illegal use of power in the administrative process,makes up for the insufficiency of the existing power control mechanism,and can quickly promote the realization of the function of administrative power control.The establishment of an internal multi-level system,an open,independent specialized technical department and the formation of technical path regulations are necessary guarantees for the smooth implementation of the technical path.The technological path itself also has functional limitations,which can neither completely replace the role of administrative staff but also have regulatory blind spots.Administrative control power needs to rely on system construction,the improvement of administrative staff’s professionalism and the joint guarantee of technical paths.
