摘 要:宅基地资格权在法律法规中并无明文规定,其法律内涵也尚不明晰,目前存在"财产权说""二元说""成员权说"等争议。从宅基地资格权的权利特征和宅基地"三权分置"的改革要求来看,"财产权说"不足以阐释宅基地资格权的权利内涵,"二元说"背离了政策要求且难以付诸实践,唯"成员权说"具有合理性且存在制度基础。宅基地资格权在本质上属于集体经济组织成员权的内容,在权能上应体现为宅基地分配请求权、居住保障请求权和宅基地收益分配请求权等方面。There is no explicit stipulation in laws and regulations on the homestead qualification right,and its legal connotation is not clear.At present,there are disputes such as"property right theory","dual theory"and"membership right theory".From the characteristics of the homestead qualification right and the reform requirements of"separation of three rights"of homestead,"property right theory"is not enough to explain the connotation of the right of homestead qualification,"dual theory"deviates from the policy requirements and is difficult to put into practice,only"membership right theory"has rationality and institutional basis.The homestead qualification right belongs to the member’s right of collective economic organization in essence,and should be embodied in the right of homestead allocation,the right of residence security and the right of homestead income distribution.
