纪昀《阅微草堂笔记》中的“情理法”观

摘　　要：《阅微草堂笔记》展现的“情理法”观,有的虽为纪昀亲友所阐发,但经其记录和整理,可以当作纪昀思想来研究。《笔记》中的“情理法”之间,“法”“理”、“理”“情”、“情”“法”有时一致,有时冲突;“法”呈现了其所包含的客观情节属性,“情(心)”呈现了其主观情感属性;“情”“理”冲突,有时表现为情感与理智在第三人身上的冲突,有时表现为情感与理智在不同行为人身上的偏缺;“情”“法”冲突,源于“法”的固定化与“情”的多层面性、多义性、复杂性。《笔记》中的“情理法”观,以纪昀对“法令”“刑”的总体观念与其亲友圈的法律实践为基础,虽有局限,但也有创获;并以“处事宽”与“论人恕”的宽恕原则为基调,对为人处事迂腐、拘泥于礼法、空谈心性的讲学家们多予批判和嘲讽,在当时的环境下,无疑具有积极的社会意义。Although some of the concepts of“emotion,reason and law”displayed in“Notes of Yuewei Thatched Cottage”were expounded by Ji Yun’s relatives and friends,they can be studied as Ji Yun’s thoughts after his records and arrangements.Among the“emotion,reason and law”in“Notes”,“law”and“reason”,“reason”and“emotion”,“emotion”and“law”are sometimes consistent,sometimes conflicting;“law”presents the objective plot attributes it contains,“emotion(heart)”presents its subjective emotional attributes;the conflict between“emotion”and“reason”is sometimes manifested as the conflict between emotion and reason in a third person,and sometimes it is expressed as the bias between emotion and reason in different actors;the conflict between“emotion”and“law”stems from the immobilization of“law”and the multi-layered,ambiguous and complex nature of“emotion”.The concept of“emotion,reason and law”in“Notes”was based on Ji Yun’s general concept of“decree”and“penalty”and his legal practice in his circle of relatives and friends.Although it had limitations,it also had achievements;based on the principle of“forgiveness”,criticized and ridiculed the lecturers who were pedantic in dealing with others,adhered to etiquette and empty talk,so under the circumstances at that time,it undoubtedly had positive social significance.
