摘  要:高校教师校内申诉制度的建构具有充足的理论和实践动力,其不仅能够回应当下的现实需求,细化教师权益保障的立法规定,更能够间接地弥补当下教师行政申诉制度的不足。高校教师校内申诉制度通过软硬法规范的结合保障教师的权益,为高校依法治校提供良好的内部环境,最大程度上保障高校充分行使自治权。基于教师权益保障的立法论视角对当下高校教师校内申诉进行规范审视可以发现,该制度需要更为明确的上位法依据作为支撑,校内申诉的处理机构及配置应统一,申诉两造的主体资格必须明确,申诉事项的具体范围宜做扩大解释,申诉过程应充分贯彻正当程序原则。通过对高校教师校内申诉制度实体和程序内容的分析,能够略窥其制度价值和运行方式,以期起到切实维护教师权益的良好目的。The construction of college teachers’on-campus appeal system has sufficient theoretical and practical motivation.It can not only respond to the current practical needs,refine the legislative provisions on the protection of teachers’rights and interests,it concurrently oindirectly make up for the short comings of the current teachers’administrative appeal system.The internal appeal system of college teachers protects the rights and interests of teachers through the combination of soft and hard law norms,provides a good internal environment for colleges and universities to run the school according to law,and ensures the full exercise of autonomy of colleges and universities to the greatest extent.From the perspective of legislation on the protection of teachers’rights and interests,it can be found that the current on-campus appeal system of university teachers needs a clearer upper legal basis as support,the handling organization and configuration of appeals in the school shall be unified,the subject qualification of both parties must be clear,the scope of specific appeal matters should be expanded,and the appeal procedure shall fully follow the principle of due process.Through the theoretical analysis of the substantive and procedural content of college teachers’on-campus appeal system,we can have a glimpse of its system value and operation mode,so as to effectively safeguard teachers’rights and interests.
