生态文明入宪背景下的环境宪法研究

摘　　要：环境宪法是指在宪法位阶上以环境保护、经济开发和可持续发展为目的的规范体系。我国环境宪法主要是宪法或宪法修正案中与环境保护有关的条文。宪法序言中“生态文明”和“美丽中国”作为国家任务的宣示,符合环境保护的宪法目的,要求通过建设符合美好生活需要的生存空间,保护人民健康的生存环境以及提高人民的生活品质。在宪法总纲中,可以得出与生态环境保护有关的基本原则和具体内容。环境保护应在宪法现有的基本权利保护的体系内涵基础上加以充实或重构,通过宪法体系的客观规范内容以及价值决定的方式,成为国家任务的一部分,而非宪法基本权利。在国家机构方面,需要重点把握国家权力的“双重体系”结构、环境宪法所蕴涵的“两项原则”以及“三权分工”。总之,“生态文明宪法”有利于建设富强民主文明和谐美丽的社会主义现代化强国,实现中华民族伟大复兴。The environmental constitution is a system of norms in the constitutional order that aims at environmental protection,economic development and sustainable development.China’s environmental constitution is mainly the provisions or constitutional amendments related to environmental protection.The preamble of the constitution declares“Eco-civilization”and“Beautiful China”as the national mission,which is in line with the constitutional purpose of environmental protection and requires the protection of a healthy living environment and the improvement of people’s quality of life by building a living space that meets the needs of a good life.In the general principles of the Constitution,the basic principles and specific contents related to ecological environmental protection can be derived.Environmental protection should be enriched or reconstructed based on the existing systemic connotation of the fundamental rights protection in the Constitution.Through the objective normative content of the constitutional system as well as the way of value determination,it becomes a part of the state mission,rather than the fundamental constitutional rights.In terms of national institutions,it is necessary to grasp the dual-mode system structure of state power and the“Two Principles”and“Division of the Three Powers”contained in the environmental constitution.In conclusion,the“Ecological Civilization Constitution”is conducive to build China into a great modern socialist country that is prosperous,strong,democratic,culturally advanced,harmonious,and beautiful by the middle of the century,and realize the Chinese dream of national rejuvenation.
