摘 要:教育应急管理权是多元主体实施的特殊权力,既有行政应急权力属性,也有教育自主权力属性。在应对新冠肺炎疫情的过程中,从政府到教育主管部门,再到各级学校,常态下的教育管理权转变为教育应急管理权,但法律规范缺少对该权力的规制。依法治国需要依法防控疫情,依法治教同样需要依法行使教育应急管理权。应当通过国家立法规范不同权力主体在突发事件不同阶段的职责权限,规范其相关程序,通过立法保护被限制的权利以及监督教育应急管理权的运行。Education emergency management power is a special one implemented by multiple subjects,with attributes of administrative emergency power and educational autonomy.In the process of coping with the COVID-19 epidemic,from governments to educational departments,and then to various levels of schools,the normal education management power has been transformed into the education emergency management power.However,there lacks the regulation of such power in legal norms.Just as the law-based governance of the country requires law-based prevention and control of the COVID-19 epidemic,the law-based management of education requires law-based exercise of education emergency management power.We should regulate the responsibilities and powers of different subjects in different stages of emergencies through national legislation,standardize relevant procedures,protect the restricted rights and supervise the operation of education emergency management power through legislation.
