监狱法治的短板、弱项及其补强研究——以广州市监狱法治指数测量为根据

摘　　要：通过对广州市四个监狱部分民警和罪犯以及广州市部分执业律师的问卷调查,共回收有效样本1427个。基于调查样本数据,采用验证性因素分析方法,创建监狱法治专家评估、公众评估指数二阶因素计算模型。根据计算模型,据以计算监狱法治专家评估指数的指标有49个,二级指数有8项;据以计算公众评估指数的指标有48个,二级指数有9项。通过对模型的运算,得出指标权重和二级指数权重。基于此,创建监狱法治指数。根据指数测量,无罪推定、罪犯权利保障、改造效率三个方面的法治建设是监狱法治的短板和弱项,行刑效果法治建设是监狱法治的优势。根据指标计算,不利证据质疑、罪犯居住环境保障、罪犯文体娱乐时间投入诸方面法治建设是监狱法治的短板和弱项,罪犯人身自由保障法治建设是监狱法治的优势。针对监狱法治的短板和弱项,合理提出具体的补强对策。This study conducted questionnaire survey among police and criminals in four prisons and practicing lawyers in Guangzhou,and collected 1,427 valid samples.Based on the survey sample data,the second-order factor calculation models of prison rule of law index of expert evaluation and public evaluation are established by using confirmatory factor analysis method.According to the calculation models,there are 49 indicators and 8 secondary indices to calculate the prison rule of law index of expert evaluation;there are 48 indicators and 9 secondary indices to calculate the prison rule of law index of public evaluation.Through the operation of the models,the weights of the indicators and the secondary indices can be calculated.Based on this,the prison rule of law index was created.According to the index measurement,the three aspects of presumption of innocence,protection of criminals'rights and reform efficiency are the shortages and weaknes of rule of law in prisons;the execution effect is the advantages of the rule of law in prisons.According to the index calculation,the shortages and weaknesse of the prison rule of law include elements such as questioning by adverse evidence,living environment,criminals'entertainment time.The protection of prisoners*personal freedom is the advantage of the rule of law in prisons.In view of the shortages and weaknesses of the prison rule of law,this paper puts forward specific reinforcement countermeasures.
