摘 要:卫生领域关乎公众生命权、健康权,具有地位重要、错误信息难以被指正、不良后果具有不可挽回性和长期性这三个特殊性质。对于卫生领域公众人物言论可以从刑法、行政法、民法三种途径进行规制。刑事责任方面,可以追究其传播虚假信息罪、寻衅滋事罪的刑事责任;行政法方面,可以按照《医疗广告管理办法》进行规制;民法方面,可以追究违反注意义务的责任。对于我国现行相关法律、法规缺乏针对性规定,内容较为宽泛且层级较低等问题,应当出台高位阶法律,进一步明确公共言论的事前预防和事后追责机制,同时加强专门监督和舆论监督,以保护公私利益。As a field related to the public’s right to life and health,the field of health has three special characteristics:the importance of status,the difficulty to correct the wrong information,and the irreparable and long-term adverse consequences.The public figures’ speech in the field of health can be regulated by criminal law,administrative law and civil law.In terms of criminal responsibility,the crime of spreading false information and the crime of provoking disturbances can be investigated;in the aspect of administrative law,it can be regulated according to the administrative measures of medical advertisements;in the aspect of civil law,the responsibility of violating the duty of care can be investigated.In view of the lack of targeted provisions,wide content and low level of relevant current laws and regulations in China,high-level laws can be introduced to further clarify the pre prevention and post accountability mechanism of public speech,and at the same time,special supervision and public opinion supervision should be strengthened to protect public and private interests.
