摘　　要：随着社会经济的不断发展,犯罪形式日益多样,秘密侦查逐渐成为侦查机关打击、控制犯罪的重要措施,同时在实施秘密侦查过程中,稍有不慎就可能会对公众隐私权构成威胁。为了更好地发挥秘密侦查的积极作用,需要在了解秘密侦查内涵、特点的基础上,发现秘密侦查中的缺陷和不足,从理念和制度建构的层面进行全面完善。With the ever-increasing development of society and economy,the forms of crime become more and more diverse.Secret investigation has gradually become an important measure to crack down on and control crime.However,the slightest carelessness in the implementation of secret investigation will also infringe on the public’s right to privacy,causing conflicts between crime control and civil rights protection in the field of criminal procedure.Therefore,in order to better play its positive role of secret investigation,the defects and deficiencies in secret investigation are needed to be understood on a basis of the connotation and characteristics of secret investigation,which will comprehensively improve it from the perspective of concept and system construction.
