以价值位阶论体育赛事公共安全风险防控的桎梏与救赎

摘　　要：受“新冠肺炎”全球范围内影响,重新考虑体育赛事公共风险防控迫在眉睫,为平衡风险防控进程之中的先后价值冲突,结合法学价值位阶理论视角论证体育赛事风险防控中现实桎梏的优先选择。研究主要采用文献研究法和逻辑分析法,从推进国家层面治理体系科学构建、保障社会层面体育相关切身利益及维系个人层面体质健康重要基石动因出发,得出桎梏因素:1)体育赛事风险源头的构成复杂;2)体育赛事风险治理的部门协同;3)体育赛事风险防控的制度固化;4)体育赛事风险防控的角色失准。消解路径:健全赛事风险的精准评估、疏通赛事部门的协同合作、活化风险防控的动态制度、定位政府参与的角色扮演。Due to the global impact of COVID-19,it is urgent to reconsider the public risk prevention and control of sports events.In order to balance the value conflicts in the process of risk prevention and control,the priority choice of practical constraints in risk prevention and control of sports events is demonstrated from the perspective of legal value hierarchy theory.The research mainly adopts literature research method and logical analysis method,starting from promoting the scientific construction of governance system at the national level,protecting the vital interests of sports at the social level and maintaining the physical health at the personal level.The following factors are obtained:1)the risk sources of sports events are complicated;2)Coordination between departments on risk management of sports events;3)The system of risk prevention and control of sports events is solidified;4)The role of risk prevention and control of sports events is inaccurate.Solution path:improving accurate assessment of event risks,dredging cooperation between event departments,activating dynamic system of risk prevention and control,positioning the role of government participation.
