摘  要:劳务外包是发包单位为解决其用工需求,将其部分业务或职能工作发包给外包单位,由该外包单位自行安排员工按照发包单位要求完成的一种非典型用工形式。劳务外包用工的泛化虽然解决了企业用工需求,降低了企业劳动法律风险,但也对正规就业造成了负面影响,一些企业利用劳务外包用工规避用工主体责任,众多劳动者经劳务外包被排除在劳动关系之外,付出超额劳动,却难以得到劳动和社会保险法律的保障。加强劳务外包人员权益保护,应细化劳务外包管理规定,落实现有用工制度,探索劳务外包集体协商有效形式,积极吸纳外包人员加入工会组织。Outsourcing is an atypical form of employment in which a contracting unit subcontracts part of its business or functional work to an outsourcing unit in order to solve its labor needs.The outsourcing unit arranges its employees to complete it in accordance with the requirements of the contracting unit.Although the generalization of labor outsourcing has solved the labor demand of companies and reduced the legal labor risks of companies,it has a negative impact on formal employment.Some companies use outsourcing to circumvent the main responsibilities of laborers.Many workers are excluded from labor relations through outsourcing and pay excessive labor.It is difficult to obtain the protection of labor and social insurance laws.To protect the rights and interests of outsourcing personnel,the following measures should be adopted,such as refine the regulations on outsourcing management,implement existing labor laws,explore effective forms of collective negotiation for outsourcing,actively attract outsourcing personnel to join trade union,etc.
