生态环境损害赔偿制度理论基础溯源——从公共信托理论的视角出发

摘　　要：《中华人民共和国民法典》第1 235条规定了对生态环境损害享有索赔权的机关与组织。但由于生态环境损害赔偿制度理论基础的构建不充分,带来的直接影响是制度设计和进一步开展过程中极易出现的逻辑不自洽等问题。因此亟需为生态环境损害赔偿制度建构起具有深厚法理支撑的法治理论体系。随着环境资源一体化保护的新型环境观的构建,传统模式下环境资源分割立法、分开保护的观念得以转变。在此新型环境观背景下,公共信托理论的回归符合当下生态文明体制改革的目标,赋予政府提起诉讼的正当性,为制度的进一步发展提供充沛的理论支撑。利用公共信托理论对生态环境损害赔偿制度理论基础作全面、细化解释,能够先行引领未来的环境资源立法模式。Article 1235 of the Civil Code stipulates the organs and organizations that have right to claim for damage to the ecological environment. However, due to the insufficient construction of the theoretical basis of the ecological environment damage compensation system, the direct impact is the problem of inconsistent logic in the process of system design and further development. Therefore, it is urgent to build a theoretical system of rule of law with deep legal support for the ecological environment damage compensation system. With the construction of the new environmental concept of integrated protection of environmental resources, the concept of divided legislation and separate protection of environmental resources under the traditional mode has been changed.Under the background of this new environmental view, the return of public trust theory is in line with the goal of the current ecological civilization system reform, endows the government with the legitimacy of litigation, and provides sufficient theoretical support for the further development of the system. Using public trust theory to make a comprehensive and detailed explanation of the theoretical basis of eco-environmental damage compensation system can lead the future legislative model of environmental resources.
