摘　　要：为了研究国内商业期刊数据库支付的著作权使用费的分配问题,在介绍当前数据库与期刊出版单位、期刊出版单位与作者、数据库与作者之间的支付现状基础上,对期刊的整体著作权和论文的著作权归属进行讨论。根据著作权归属对著作权使用费的分配提出了意见,并对著作权使用费存在的误用可能导致的法律和财务风险,提出了建议。In order to study the distribution of copyright royalties paid by China’s commercial journal databases,this article introduces the current status of payment between databases and the editorial department,the editorial department and authors,databases and authors.We also discuss the overall copyright of the journal and the copyright ownership of papers,and give some advices on the distribution of copyright royalties according to the copyright ownership.Moreover,we put forward some suggestions on the legal and financial risks caused by the misuse of copyright royalties,which can provide reference for standardizing publishing behavior.
