后疫情时代野生动物保护执法优化——基于对全国人大常委会《决定》的解读

摘　　要：野生动物保护执法对于维系生物多样性、推进生态文明建设意义重大,并且关系人民群众生命健康安全和突发公共卫生风险的有效防范与化解。我国野生动物保护取得了一定成绩,然而,就执法现状而言,野生动物保护的执法理念、执法依据、执法程序、执法体制、公众参与等各方面仍有较大优化空间。2020年2月,全国人大常委会《决定》对野生动物保护及其执法提出了新要求,应正确解读。后疫情时代应赋予执法以新的内涵,即以执法手段阻隔自然界病毒在人与野生动物之间的传染链条,保证人与野生动物和谐共生。为此,执法部门应贯彻《决定》精神,根据新发展阶段推进依法行政、全面建设法治政府的总体要求,切实优化野生动物保护执法。Wildlife conservation enforcement is of great significance for maintaining biodiversity and promoting the construction of ecological civilization in China.It is also contributing to the safety of people’s life and health and the prevention of emerging public health risks.Wildlife protection in China has made certain achievements.However,its administrative law enforcement still has room for improvement,especially in aspects of legal philosophy,basis,enforcement procedure,institution and public participation.In February 2020,Decision of the Standing Committee of the National People’s Congress put forward new requirements for wildlife conservation and its enforcement,which should be interpreted correctly.Post-epidemic society should endorse new connotation to law enforcement for wildlife protection.For example,law enforcement shall be the key instrument to prevent transmission of virus between human-being and animals to ensure their co-existence.To the end,all law enforcement agencies should take actions according to the Decision,meet the overall requirements of the promotion of administration under law and the construction of a rule-of-law government,and optimize the enforcement for wildlife protection.
