涉疫矛盾纠纷化解中的“不可抗力公证”问题探讨

摘　　要：新冠肺炎疫情的突发和肆虐使得民众对“不可抗力公证”的需求上升。但基于目前“不可抗力公证”的制度规范不健全、理论研究欠缺、公平与效率原则失衡等原因,“不可抗力公证”的运行现状存在含义模糊、申请主体范围混乱、公证机关直接出具不可抗力证明和定式格式书第31式模板不合理等问题。为了高效化解涉疫矛盾纠纷,推动公证制度改革,有必要明确“不可抗力公证”的含义和有权申请的主体,对公证机构直接出具不可抗力证明加以限定,并对公证书格式进行完善。Demands for force majeure notarization has increased because of the outburst and raging of the COVID epidemic.However,the current operation status of force majeure notarization has some problems,such as vague meaning,confusion in application subjects scope,unreasonable force majeure certificate directly issued by the notary office and the unreasonable 31st template of the format book,which are due to the imperfect system and norms,the lack of theoretical research,the imbalance between the principles of fairness and efficiency and so on.In order to efficiently resolve the epidemic-related disputes and promote the reform of the notarization system,it is necessary to clarify the meaning of force majeure notarization and the subject who has the right to apply,set limitation that the notarial institution should not directly issue the certificate of force majeure,and improve the format of the notarial certificate.
